TERMS AND CONDITIONS OF SALE

These are the conditions of sale for Mayfair Gallery Limited (“Mayfair Gallery”, “we”, “us”, “our”), a company registered in England & Wales under company number 01742251, and VAT number 341 48 5265. The registered address for Mayfair Gallery is Lynwood House, 373-375 Station Road, Harrow, Middlesex, HA1 2AW.

These conditions of sale set out the terms for the sale of works by Mayfair Gallery in store and online at www.mayfairgallery.com.

Mayfair Gallery operates under HM Revenue & Custom’s VAT Margin Scheme, for the sale of antiques, works of art, collectors’ items and second-hand goods. The sale of works within the United Kingdom will be under the margin scheme, unless otherwise specified. Input tax deduction has not been and will not be claimed in respect of works sold under the margin scheme. Sale of works outside of the United Kingdom will be treated as exempt of VAT.

Product details and condition

The works available from Mayfair Gallery are sourced globally and chosen for their beauty, rarity, historical importance and/or display of skill and craft. It should be noted that these works are antique or vintage and, as such, it should be expected that there will be some signs of wear. On request, we will provide a condition report and additional images of works. We will be happy to accommodate any reasonable requests to help make a purchasing decision.

Additional details provided such as attribution, description, date, age and country origin are as accurate as possible, but constitute our judgement and opinion and are not warranted by us. Dimensions provided are approximate and may comprise estimates in certain circumstances. We ask that customers clarify with us any dimensions that are essential to their decision making.

Payment

Payment to Mayfair Gallery can be made through the website by debit or credit card. Alternatively, we accept payment by wire transfer, cheque or cash (subject to limits and conditions). Please contact us when making an order if you wish to use one of these alternative payment methods.

Payment is usually required in full, but special payment terms may be available and if so will be agreed in writing. Any failure to comply with payment terms will incur interest charges of 4% per annum above the Bank of England base rate, from the payment due date until the date of payment. We reserve the right to cancel any sale if payment terms are breached. Any deposit agreed and paid to reserve or secure a work will be non-refundable in the case that the order is subsequently cancelled.

Full legal title to the works will not pass until payment is received in full in cleared funds.

Shipping and Delivery

All works are available for collection from the Mayfair Gallery store or warehouse, both of which are located in London.

Free international delivery is available only for those items purchased at the full list price, and is subject to confirmation and international law. Free international delivery is for a standard service and includes professional packing and insurance. Express delivery service or special delivery requirements should be requested by contacting the gallery by phone or email. These shipping specifications may incur additional charges, which will be clearly explained to the customer.

In exceptional circumstances, or for unusually large or heavy items, Mayfair Gallery reserves the right to enforce a collection only policy. This will be clearly set out to the customer at the time of order. In such a situation, we can provide advice and help to arrange the work’s delivery if requested, but ultimate shipping responsibility will lie with the customer.

For international delivery, it is the customer’s responsibility to pay any taxes including but not limited to import tax, duty, merchandise, sales or user tax that have to be paid in the country of destination whether on shipment, or on import, or at any other time.

Returns and refunds for consumers

The following clause only applies if you are deemed to be a consumer for the purposes of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

Consumers are entitled to return any works purchased online for a full refund within 14 days of receiving physical possession of the works. In this situation, the customer should notify Mayfair Gallery of their decision to return the works by post, email or by completing the model cancellation form, within the 14 day time period. The cost of the return delivery is to be borne by the customer. The works should be returned to Mayfair Gallery in the same condition as when despatched from us, within a further 14 days from the date of notification. Any deterioration in condition may affect the customer’s right to a full refund. The works will remain the responsibility of the customer until they are physically received by Mayfair Gallery. Returns are not accepted for works purchased in store. Customers should satisfy themselves about the works purchased before submitting an order, as all in store sales are final.

Trade customers are not permitted to return works once they have been dispatched and should satisfy themselves about the works before submitting an order, as all sales are final.
